WATERLOO, Iowa (AP) — A Waterloo man who was shot by police five times has filed a lawsuit.

27-year-old Jovan Webb filed the lawsuit Wednesday in U.S. District Court, alleging excessive force, battery and failure by other officers to intervene. The suit names two officers and the city.

The incident occurred in April after police responded to a disturbance at a Waterloo nightclub.

As officers arrived, Webb drove away. Police claim he drove toward an officer, prompting police to open fire.

Webb was shot five times but managed to drive himself to a hospital.

Webb says he didn't know the person who tapped on his window was an officer and denies driving toward an officer.

City Attorney David Zellhoefer says the city will "vigorously" defend itself.
