CHARLES CITY, Iowa (AP) — A Charles City man convicted of killing his 3-year-old cousin has been scheduled to be resentenced in the case in October.

The Mason City Globe Gazette reports (http://bit.ly/1fesBeN ) a resentencing hearing for 19-year-old Edgar Concepcion Jr. is set for Oct. 1 at the Floyd County District Court in Charles City.

Concepcion was convicted of first-degree murder and other charges in connection to the July 2009 death of Krystel Banes. Concepcion was 14 at the time of the death.

Concepcion was sentenced in November 2010 to life in prison without the possibility of parole. The Iowa Court of Appeals later upheld his convictions but overturned his sentences.

A recent U.S. Supreme Court ruling called such life sentences for juveniles unconstitutional.
