WATERLOO, Iowa (AP) — A hearing has been pushed to next year for a man seeking a new trial in a 2006 shooting death at a Waterloo nightclub.

Attorneys for Jeffrey Smith started presenting evidence Sept. 8, arguing that Smith's cellphone records show he was on the phone on the other side of town when Tonyeah Jackson was shot and killed at Club Crystyles in July 2006.

After a day of testimony, one of Smith's attorneys was injured, and the hearing was put on hold. The hearing has now been rescheduled for February.

Prosecutors say Smith shot Jackson as revenge for an earlier argument in which Jackson hit him during a fight with a girlfriend.

Smith was convicted in 2009 of first-degree murder and sentenced to life.
